David Beard, 63, Killed in Pedestrian Crash at Golden State Blvd, Golf Rd in Turlock

Turlock, CA – On Monday, December 2, 2024, 63-year-old pedestrian David Beard of Turlock was fatally struck in a collision at Golden State Boulevard and Golf Road, according to The Modesto Bee.

Officers of the California Highway Patrol (CHP) responded to reports of a pedestrian accident and arrived at the scene around 7:36 PM. Upon arrival, they discovered Beard lying in the roadway. Emergency responders transported him to Doctors Medical Center in Modesto, where he later succumbed to his injuries.

Investigations indicate that Beard may have run eastward from the west shoulder of Golden State Boulevard, into the path of a northbound 2021 Chevrolet pickup truck.

The driver, identified as 44-year-old Duraye Kinhoo, also of Turlock, remained at the scene and cooperated with authorities. The CHP confirmed that Kinhoo was not impaired by drugs or alcohol at the time of the collision.

Partial Liability in Pedestrian Accidents

California Law does not consider pedestrians to have the right-of-way under all circumstances, such as if they attempt to cross outside of a crosswalk. However, motorists are never relieved of the expectation to provide pedestrians with a Duty of Care toward their safety.

It may therefore be determined that a motorist is held only partially liable in a pedestrian accident. Should that be the case, they would be financially responsible for the victim’s recovery costs in proportion to their degree of liability.

If you or someone you love was harmed in an accident like the one described here, feel free to contact Maison Law for any questions or to receive a no-cost, no-obligation case assessment.
