UPDATE: Brent Allen Evans, 38, ID’ed as Bakersfield Man Fatally Struck after Falling Off His Bicycle near Airport Dr, Washington Dr

Bakersfield, CA – The Kern County Coroner has identified 38-year-old Brent Allen Evans of Bakersfield as the man who was struck by a vehicle and killed after falling off his bicycle on Tuesday, December 10, 2024, according to KBAK.

The California Highway Patrol (CHP) reports that the fatal accident occurred around 7:30 PM on Airport Drive south of Washington Drive.

Investigations suggest that Evans fell off his bicycle while attempting to cross Airport Drive. While he was still lying in the roadway and attempting to get back onto his feet, a 2009 Honda Accord traveling northbound on Airport Drive at a speed of approximately 40 miles per hour struck and severely wounded Evans.

The driver involved stopped immediately and has reportedly been cooperating with law enforcement regarding this accident. Despite the life-saving efforts of emergency responders from the Kern County Fire Department, Evans was pronounced dead at the scene.

Authorities have not yet indicated whether drugs or alcohol are believed to have played a role in this fatal accident. The investigation into the causes of the accident is ongoing.

Partial Liability in Bicycle Accidents

California Law does not consider bicyclists to have the right-of-way under all circumstances, such as if they attempt to cross outside of a crosswalk. However, motorists are never relieved of the expectation to provide bicyclists with a Duty of Care toward their safety.

It may therefore be determined that a motorist is held only partially liable in a bicycle accident. Should that be the case, they would be financially responsible for the victim’s recovery costs in proportion to their degree of liability.
