Pedestrian Injured in Crash at Ashlan, Blackstone Ave in Fresno

Fresno, CA – A man in his early 60s was critically injured Monday morning, December 30, 2024, after being struck by a vehicle at the intersection of Ashlan and Blackstone Avenues, according to The Fresno Bee.

Fresno Police reported that, shortly before 7 AM, the driver was heading northbound on Blackstone Avenue in the number one lane, south of Shields Avenue, when the pedestrian was struck as he walked west across the roadway.

Emergency responders transported the man to Community Regional Medical Center, where he was listed in critical condition. Investigators stated that the cause of the collision remains under investigation, and it is currently unclear who was at fault.

The driver involved remained at the scene and cooperated fully with police during the investigation. No further details about the circumstances of the accident have been released at this time.

 

Partial Liability in Pedestrian Accidents

California Law does not consider pedestrians to have the right-of-way under all circumstances, such as if they attempt to cross outside of a crosswalk. However, motorists are never relieved of the expectation to provide pedestrians with a Duty of Care toward their safety. 

It may therefore be determined that a motorist is held only partially liable in a pedestrian accident. Should that be the case, they would be financially responsible for the victim’s recovery costs in proportion to their degree of liability.
